1.General Provisions

1.1. This User Agreement (hereafter – Agreement), prepared in accordance with the law of the Republic of Kazakhstan “On personal data and its protection”, regulates relationships between a personal data subject (hereafter – User) and the Republican State Enterprise on the right of economic management “National Nuclear Center of the Republic of Kazakhstan”, Ministry of Energy, Republic of Kazakhstan (hereafter – RSE NNC RK).

1.2. This Agreement is a public offer. The User shall be considered to have entered and accepted all the terms of this Agreement by obtaining access to the materials of the RSE NNC RK’s website – https://www.nnc.kz/ (hereafter – Website) and its components.

1.3. By signing this Agreement, the User thereby agrees to the collection, processing and use of his/her personal data and other information presented by the User on the website.

1.4. Personal data, for collection and processing of which the User shall give his/her consent, include:

Surname;

Name;

Patronymic name (if available);

Contact information: mobile telephone number, e-mail address, place of residence; employer, position, academic degree or status;

1.5. The consent can be withdrawn by sending to RSE NNC RK a notice requesting to terminate personal data collection and processing.

1.6. RSE NNC RK has the right to unilaterally amend the terms and conditions of the Agreement at any time. The amendments enter into force three (3) days after the new version of the Agreement is issued on the Website, while the previous version of the Agreement is considered terminated.

 

2. Rights and Obligations of Parties

2.1. RSE NNC RK has the right to:

2.1.1. Verify the accuracy of the User’s input data, including the right to apply to state bodies and other organizations, if necessary.

2.1.2. Refuse User registration, delete or block User account in case the User violates the terms of this Agreement.

2.1.3. RSE NNC RK has the right to send out notifications to User’s e-mail.

 

2.2. User has the right to:

2.2.1. Receive advice and assistance from RSE NNC RK concerning the use of the Website and its components, by contacting the telephones listed in the “Contacts”.

 

2.3 RSE NNC RK has the obligation to:

2.3.1. Protect the privacy of the User personal data by preventing its disclosure without consent of the User or his/her legal representative.

2.3.2. Ensure a proper functioning of the Website and its components.

 

2.4. User has the obligation to:

2.4.1. Provide accurate and complete information in the registration form of RSE NNC RK Website or when using its components.

2.4.2. Not to take any action that may be considered as a violation of legislation of the Republic of Kazakhstan or standards of international law, including in the area of intellectual property, copyrights and/or related rights, as well as any actions that result or may lead to a violation of the normal operation of the Website and its components.

2.4.3. Avoid any conflict of User comments and other records added to the Website with the requirements of legislation of the Republic of Kazakhstan and generally accepted moral and ethical standards.

2.4.4. When working on the Website not to impersonate another person, not to upload material that contains viruses or not to use other malicious software.

2.4.5. Not to use the Website and its information for terrorism, extremism, inciting ethnic hatred or for other purposes prohibited by applicable law of the Republic of Kazakhstan.

 

3. Liability of the Parties

3.1. In case of violation of the terms of this Agreement that have adversely affected both or one of the Parties of the Agreement, the Party at default bears responsibility in accordance with the law of the Republic of Kazakhstan.

3.2 RSE NNC RK is not responsible for technical temporary failures and interruptions in the operation of the Website and its components that arose for reasons beyond the control of RSE NNC RK or in case of scheduled or unscheduled work on the Website and its components maintenance.

3.3. RSE NNC RK is not responsible for temporary disruptions and interruptions in the operation of communication lines, other analogous failures, as well as malfunctions of a computer, mobile device from which the User accesses the Website and its components.

3.4. RSE NNC RK is not responsible to the User for any actions of other Users.

3.5. RSE NNC RK is not responsible for any direct or indirect damage, including loss of profit, damage from use, loss of data or any other non-material losses, damage to the reputation or other damage resulting from

3.5.1. User use or inability to use the Website and its components;

3.5.2. RSE NNC RK amendments made to the terms of the Agreement;

3.6. The user is fully responsible for accuracy of data he/she provided at the time of registration at the Website and its components, as well as for data timely updating and adjustment during the use of the Website.

3.7. The User assumes all risks and potential damage, which may result from providing false personal data, as well as from transmitting personal data related to registration at the Website and its components, and use of its components, to third parties.

 

4. Miscellaneous

4.1. All possible disputes arising from or related to this Agreement are subject to resolution in accordance with the current legislation of the Republic of Kazakhstan.

4.2 This Agreement shall come into force upon the User’s express agreement on its conditions by pressing “I have read and agree with the terms of the User Agreement” in Web-interface, under the text of the Agreement.
